Federal vs. State: Debating the fate of Data Breach Notification Laws

Until California passed a law requiring business to notify consumers’ in the event personal identifying information was breached, this type of disclosure was unheard of. To date, an estimated 51 million personal identifying numbers have been compromised – prompting other states to enact similar laws. Congress is now weighing several national bills that in most cases would preempt existing state breach notification laws, creating a federal standard. But will a new federal standard breach notification law go far enough? This panel of experts will share their views on the laws pending in Congress and what can be done to foster better security practices.
